The aim of this study is twofold: one, to determine the presence and function of scientific knowledge when it is required by such cases as `mad cow' disease, when the crisis breaks in the press; and two, to explore the role of scientific information through the analysis of quoted speech used by journalists in their discourse. Citation is the most explicit form of inclusion of other-discourse in one's-discourse. Within the framework of the theory of énonciation, in combination with a critical (...) view of discourse, we analyse the following: the identity of agents of reference chosen by journalists; the specific linguistic choices made in the pre-citation segment where the agents are introduced, that is, identification of discourse procedures and use of specific verbs of communication. The study shows the proportion of scientific and non-scientific voices, the different ways of representing science agents in the process of news communication as well as the use of citation by journal writers not just to confer authority and legitimation to their discourse but to set the scene of the conflict. The scientific role is not presented as a decisive social role capable on its own of reassuring public alarm and journalists fail to secure appropriate credibility for the scientific community. Tradicionalmente, el patrimonio se ha relacionado con la educación histórica desde una perspectiva restrictiva que dejaba fuera a buena parte de las manifestaciones patrimoniales, entre ellas, las que se incluyen en el ámbito del patrimonio inmaterial. En este sentido, el presente trabajo se centra en la relación entre patrimonio inmaterial y pensamiento histórico dentro de la formación del profesorado de Educación Primaria. Desde el paradigma interpretativo se han analizado 27 propuestas didácticas de un total de 54 estudiantes del Grado de (...) Educación Primaria, con el propósito de conocer la percepción que poseen del uso del patrimonio inmaterial para trabajar los conceptos asociados al desarrollo del pensamiento histórico. Los datos obtenidos apuntan a la existencia de una alta consideración del patrimonio inmaterial para trabajar el pensamiento histórico en la Educación Primaria. (shrink)

Este trabajo aborda el pacto librepensador suscri­to por las autoras Rosario de Acuña y Ángeles López de Ayala. Se examinan sus contribuciones en la prensa librepensadora y su activismo feminista a través de un análisis de sus colabora­ciones en Las dominicales del librepensamiento, El gladiador: órgano de la “Sociedad progresiva femenina” y El gladiador del librepensamiento. La ideología de estas publicaciones les permitió vincular la lucha feminista con la agenda política de ideología progresista. Se parte de dos ejes complementarios (...) cuya intersección permite abordar su pacto de compromiso y transgresión: la lucha por la igualdad social y por la igualdad de género. Se estudian sus reflexiones sobre la explotación del pueblo por las castas, el empoderamiento de la mujer como agente constructor del progreso y la denuncia vehemente de su sometimiento. Se concluye que los escritos de Acuña y Ayala evidencian con el paso de los años una radicalización que pro­picia una postura cada vez más trasgresora y un feminismo más combativo, reflejando así su descontento con la actitud pater­nalista u hostil del librepensamiento y el republicanismo mas­culino en lo que respecta a los derechos de la mujer. In most domains of human life, we are willing to accept that there are experts with greater knowledge and competencies that distinguish them from non-experts or laypeople. Despite this fact, the very recognition of expertise curiously becomes more controversial in the case of “moral experts”. Do moral experts exist? And, if they indeed do, are there ethical reasons for us to follow their advice? Likewise, can emerging technological developments broaden our very concept of moral expertise? In this article, we begin (...) by arguing that the objections that have tried to deny the existence (and convenience) of moral expertise are unsatisfactory. After that, we show that people have ethical reasons to ask for a piece of moral advice in daily life situations. Then, we argue that some Artificial Intelligence (AI) systems can play an increasing role in human morality by becoming moral experts. Some AI-based moral assistants can qualify as artificial moral experts and we would have good ethical reasons to use them. (shrink)

Consensual homicide remains a crime in jurisdictions where active voluntary euthanasia has been legalized. At the same time, both jurisdictions, in which euthanasia is legal and those in which it is not, recognize that all patients (whether severely ill or not) have the right to refuse or withdraw medical treatment (including life-saving treatment). In this paper, I focus on the tensions between these three norms (the permission of active euthanasia, the permission to reject life-saving treatment, and the prohibition of consensual (...) homicide), assuming a justification of euthanasia based on the right to (personal) autonomy. I argue that the best way to provide a coherent account of these norms is to claim that patients have two distinct rights: the right to autonomy and the right to bodily integrity. This solution has some relevant implications for the discussion of the legalization of active euthanasia. (shrink)

Love enhancement can give us as a say on whom we love and thus ‘free’ us from our brain chemistry, which is mostly out of our control. In that way, we become more autonomous in love and in our life in general, as long as love enhancement is a free, voluntary choice. So goes the argument in favour of this addition to medical interventions of relationships. In this paper, I show that proponents of love enhancement have overlooked, or at least (...) underestimated, the fact that love itself impacts people’s choices. Since this could include the choice for love or anti-love drugs, I call for a re-formulation of the underlying view on autonomy before this medical intervention is made available to the public. El objetivo de este artículo es definir la concepción del acto involuntario de Francisco Suárez y mostrarla como un medio que permite comprender y profundizar en su teoría de la acción humana. En esta cuestión, el Doctor Eximio parte de presupuestos elaborados por Tomás de Aquino que amplía y adapta siguiendo sus propias tesis metafísicas y teológicas sobre la relación entre Dios y las creaturas. Mostraremos cómo Suárez vincula el verdadero involuntario con el _simpliciter_, lo forzado, necesario e indeseado, dejando (...) al _secundum quid_ como un acto mixto en el que la libertad y la voluntad, pese a las injerencias externas, no quedan anuladas. Por último, subrayaremos las consecuencias de la definición suareciana de lo involuntario sobre la noción de libertad, haciendo patente que tanto una como otra serían imposibles fuera del marco teórico que él sustenta, caracterizado por la eficiencia humana (y su dependencia de la divinidad) y no por la premoción física. This book addresses the European Court of Human Rights’ fairness standards in criminal appeal, filling a gap in this less researched area of studies. Based on a fair trial immediacy requirement, the Court has found several violations of Article 6 of the European Convention on Human Rights at the appellate level by at least eighteen States of the Council of Europe in a vast array of cases, particularly in contexts of first instance acquittals overturning and of sentences increasing on appeal. (...) -/- On the one hand, the book critically engages this case-law with the law revisions it has recently inspired in European countries, as well as with the critiques and difficulties that it continues to raise. The aim of the article is to define the tendencies of elaboration of ethical problems in early medieval exegetical texts - treatises of post-canonical Abhidharma. Ethics as a specific philosophical discipline concerning morals was not specifically developed because of cosmological character of Buddhist philosophy. Explication of the ethical discourse presented in treatises of eminent early medieval Indian Buddhist exegetics Vasubandhu, Asaṅga and Yaśomitra showed that specific for ethics questions on the highest good, sense of human life, the nature and sources (...) of morals, freedom of will etc. were solved in post-canonical period. According to the religious doctrine they interpreted the highest good as the benefit of liberation from the fetches of suffering. The Buddha’s moral instructions known as prātimokṣa is aimed at the attainment of the highest good. Therefore the essence of morality has nothing to do with saṃsāra, and human society forming and perishing in cosmic cycles cannot be the source of moral norms. According to historiosophical myth, human beings get the first instructions on righteous behavior in deep antiquity from charismatic Universal ruler coming to the world as the forerunner of the Buddha. He explains ontological contrariness of the good and the evil but is not the Teacher of the truth. Freedom of will cannot manifest itself spontaneously in a human being attached affectively to saṃsāra. Such an individual falsely takes his ignorant self-will for the freedom of will. Hearing the sermons of salvific teaching is the condition for the rising of free will impulse. (shrink)

The purpose of the research is to explicate the Buddhist principles of ethical analysis of premeditated murder as an immoral act. The author solves this problem through the method of case study of exegetical treatises of outstanding Buddhist thinkers Vasubandhu (4th-5th centuries) and Yašomitra (8th century). It is shown that the ethical analysis of premeditated murder is based on a religious anthropological concept (the Buddhist doctrine of human action producing karmic retribution). Sinful intent is interpreted as an immoral mental urge (...) that generated a verbal intention to take the life of a certain person or a certain animal. According to the canonical point of view, there are three mental roots of immoral acts - greed, hatred, ignorance. The ethnical analysis of sinful intent is aimed at determining the connection of intent with any of these three mental phenomena. In accordance with this principle, Buddhist thinkers have identified three types of premeditated murder. All of them produce a “black” (unfavorable) karmic fruit, i.e. an unfortunate form of rebirth, exacerbating physical suffering. Great attention is paid by the author to the problem of the karmic responsibility of individuals ordering murders and the executors of such orders. In the considered sources, the verbal order to kill and its physical execution are interpreted as equally immoral actions that produce collective karmic responsibility. The author of the research examines in detail a special class of premeditated murder, fraught with inevitable infernal retribution. This class includes murders of benefactors (mother, father, arhat) and Buddhist ascetics practicing asceticism. These malicious sins were interpreted as an insurmountable obstacle to achieving a soteriological goal, even in the distant transcendental future. It is shown that Buddhist exegetes have developed principles for diagnosing these sins and characterized the immoral personal characteristics of sinners (disrespect towards parents, Buddhist preachers and religious ascetics, heretical denial of spiritual values, shamelessness, arrogance, ignorant self-will, misanthropy). Purpose The purpose of this paper is to report on empirical work conducted to open up algorithmic interpretability and transparency. In recent years, significant concerns have arisen regarding the increasing pervasiveness of algorithms and the impact of automated decision-making in our lives. Particularly problematic is the lack of transparency surrounding the development of these algorithmic systems and their use. It is often suggested that to make algorithms more fair, they should be made more transparent, but exactly how this can be (...) achieved remains unclear. Design/methodology/approach An empirical study was conducted to begin unpacking issues around algorithmic interpretability and transparency. The study involved discussion-based experiments centred around a limited resource allocation scenario which required participants to select their most and least preferred algorithms in a particular context. In addition to collecting quantitative data about preferences, qualitative data captured participants’ expressed reasoning behind their selections. Findings Even when provided with the same information about the scenario, participants made different algorithm preference selections and rationalised their selections differently. The study results revealed diversity in participant responses but consistency in the emphasis they placed on normative concerns and the importance of context when accounting for their selections. The issues raised by participants as important to their selections resonate closely with values that have come to the fore in current debates over algorithm prevalence. Originality/value This work developed a novel empirical approach that demonstrates the value in pursuing algorithmic interpretability and transparency while also highlighting the complexities surrounding their accomplishment. The European Commission has recently proposed the introduction of legally binding quotas for women on corporate boards of European companies. This proposal has put the spotlight on the question of whether increasing female representation on the board brings economic benefits to the firm. In order to shed light on the issue, this study investigates the direct and indirect effects of women on the board on firm value. We use a simultaneous equation model to estimate the effects of women on the (...) board on firm value, financial performance, and compliance with ethical and social principles adopted by the firm. We find no evidence that a higher female representation on the board directly affects firm’s value. However, we find indirect effects. Women on the board are positively related with financial performance (measured in terms of return on assets and return on sales) and with ethical and social compliance, which in turn are positively related with firm value. The findings in this study suggest that greater female representation on corporate boards of large European firms can increase firm value indirectly. Further, part of the indirect effect comes from stronger compliance with ethical principles, something that is not captured by accounting-based financial performance. (shrink)

Servant leadership offers a compelling ideal of self-sacrificing individuals who put the needs of others before their own and cultivate a culture of growth in their organisations. Although the theory’s attempts to emphasise the moral, emotional and relational dimensions of leadership are laudable, it has primarily assumed a decontextualised view of leadership untouched by power. This article aims to problematise servant leadership by undertaking an intersectional analysis of an Asian cis-male heterosexual senior manager in Australia. Through in-depth interviews with the (...) manager and his staff, the article shows how his attempts to practice servant leadership were informed by intersecting power dynamics of race, gender, sexuality, age and class that subordinated him to white power. The findings demonstrate the ways servant leadership is necessarily embedded in wider power structures that shape who gets to be a “servant leader” and who remains merely a “servant”. (shrink)

Decision-making capacity is the gatekeeping element for a patient’s right to self-determination with regard to medical decisions. A DMC evaluation is not only conducted on descriptive grounds but is an inherently normative task including ethical reasoning. Therefore, it is dependent to a considerable extent on the values held by the clinicians involved in the DMC evaluation. Dealing with the question of how to reasonably support clinicians in arriving at a DMC judgment, a new tool is presented that fundamentally differs from (...) existing ones: the U-Doc. By putting greater emphasis on the judgmental process rather than on the measurement of mental abilities, the clinician as a decision-maker is brought into focus, rendering the tool more of an evaluation guide than a test instrument. In a qualitative study, the perceived benefits of and difficulties with the tool have been explored. The findings show on the one hand that the evaluation aid provides basic orientation, supports a holistic perspective on the patient, sensitizes for ethical considerations and personal biases, and helps to think through the decision, to argue, and to justify one’s judgment. On the other hand, the room for interpretation due to absent operationalisations, related ambiguities, and the confrontation with one’s own subjectivity may be experienced as unsettling. (shrink)
